What to Do After a Car Accident

The steps you take immediately after a car accident shape the value of your claim. Your health comes first: check everyone involved for injuries and seek medical help at once if anyone is hurt.

Once you are safe, protect your claim:

  • Call the police and report the accident.
  • Photograph the scene, the vehicles, the damage, and any visible injuries.
  • Collect the other driver’s name, insurance, and vehicle details.
  • Find any witnesses and take their contact information.
  • Do not admit fault to anyone.

That last point matters more than any other. Do not admit fault to the police, the other driver, paramedics, witnesses, or any insurance company. Even if you believe you were partly to blame, the facts often prove otherwise, and an early admission can be used to cut your compensation.

How California Car Accident Claims Work

Every California personal injury claim rests on two questions: liability and damages. Liability asks whose fault the accident was. Damages measure the harm that fault caused.

Most car accident cases turn on negligence. Every driver owes a duty to operate their vehicle safely. When a driver breaches that duty and causes harm, they are liable for the damages that follow.

California is a comparative negligence state. Fault is assigned in percentages, and your compensation reflects the other party’s share of the blame. A driver who is rear-ended usually bears no fault and can recover 100% of their damages. Where two drivers share the blame, recovery is reduced by each party’s percentage of fault.

Damages fall into two categories.

Economic damages cover measurable financial losses: medical bills, future medical care, lost wages, lost earning capacity, property damage, and out-of-pocket costs.

  5. Maintain your vehicle. Regular servicing prevents sudden stalls and mechanical failures.
  6. Look 10–12 seconds ahead. Give yourself room to react to a sudden stop or swerve.
  7. Check behind when reversing. Do not rely on mirrors alone. Parking-lot collisions are common.
  8. Do not tailgate. Keep enough distance to see the rear tyres of the car ahead.
  9. Drive courteously. Treat other drivers as you would want to be treated, and report dangerous driving to the authorities.
